Acceptance of Terms

By accessing or using the website at chulavistaasphaltpaving.com (the "Site") or by engaging Chula Vista Asphalt Paving ("we," "us," or "our") for services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or our services.

These Terms apply to all visitors, customers, and others who access the Site or retain our services.

Description of Services

Chula Vista Asphalt Paving provides asphalt paving, sealcoating, repair, and related services to residential and commercial customers in Chula Vista, CA and the surrounding South Bay area. The specific scope of work for any project is defined in a written estimate or agreement provided to the customer before work begins.

We reserve the right to decline any service request at our discretion.

Estimates and Pricing

All estimates are provided in writing and reflect conditions observed at the time of the site visit. Estimates are valid for 30 days from the date of issue unless otherwise stated.

Final pricing may change if conditions differ materially from what was observed during the estimate - for example, if hidden base damage is discovered during demo, or if the customer requests changes to the scope of work after the estimate is accepted. We will notify you of any price change before proceeding.

Verbal quotes are not binding. Only written estimates signed by an authorized representative of Chula Vista Asphalt Paving constitute a commitment to perform work at a stated price.

Scheduling and Cancellations

Scheduled work dates are subject to change due to weather, equipment availability, or other factors outside our control. We will contact you as soon as possible to reschedule.

If you need to cancel or reschedule a confirmed appointment, please notify us at least 48 hours in advance by calling (858) 341-1003 or emailing contact@chulavistaasphaltpaving.com. Cancellations made less than 24 hours before a scheduled start time may be subject to a mobilization fee to cover crew and equipment costs.

Asphalt work requires dry conditions and appropriate temperatures. We reserve the right to delay or reschedule work due to rain, high winds, or temperatures outside the recommended range for proper installation.

Payment Terms

Payment terms are outlined in each written estimate or agreement. Generally:

• A deposit may be required before work begins on larger projects.
• Final payment is due upon completion of the work, unless otherwise agreed in writing.
• Accepted payment methods will be specified in your written agreement.

Unpaid balances past the due date may be subject to late fees. We reserve the right to pursue collection of unpaid amounts through all available legal means, including recovery of reasonable attorney fees and collection costs where permitted by law.

Customer Responsibilities

To ensure work can proceed safely and on schedule, customers are responsible for:

• Clearing vehicles, equipment, and personal property from the work area before the scheduled start time.
• Providing clear access to the work site for our crew and equipment.
• Notifying us of any underground utilities, irrigation lines, or other obstructions in or near the work area.
• Obtaining any required HOA approvals or permits, unless we have expressly agreed in writing to handle permitting as part of the project.

We are not responsible for damage to underground utilities or structures that were not disclosed before work began.

Warranty Disclaimers

We stand behind our work. Any warranty terms applicable to your specific project will be stated in your written estimate or agreement.

Asphalt is a natural material subject to environmental factors including sun exposure, ground movement, and weather. Normal wear, fading, minor surface cracking, and scuff marks from turning vehicles are expected over time and are not covered by any warranty. Warranty coverage does not apply to damage caused by tree roots, soil settlement, heavy vehicle loads exceeding normal residential or commercial use, or failure to follow post-installation care instructions.

Except as expressly stated in a written agreement, we make no warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, Chula Vista Asphalt Paving will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or from our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of a service we perform is limited to the amount you paid us for that specific service.

Use of the Website

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that could damage or impair its function.
• Attempt to gain unauthorized access to any part of the Site or its underlying systems.
• Use the Site to transmit spam, malicious code, or unsolicited communications.
• Reproduce, distribute, or create derivative works from Site content without our written permission.

Intellectual Property

If we cannot resolve a dispute informally, the parties agree to submit to binding arbitration in Chula Vista, CA, under the rules of the American Arbitration Association, before pursuing litigation. This does not prevent either party from seeking injunctive or other equitable relief in court where appropriate.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any legal proceedings not subject to arbitration will be brought in a court of competent jurisdiction in California.
